Overage - new positive covenant

This document contains a draft deed of covenant intended to be used in connection with a restricted disposition, in relation to which a disponee is required to enter into a fresh positive covenant. This form of deed of covenant is drafted for use in connection with binding overage obligations whereby successors in title become directly bound by the overage obligations.

Note that although the overage deed itself may contain restriction provisions which ensure that a Land Registry restriction is placed upon the original overage covenantor's title, this deed of covenant contains a further application provision to ensure that the original restriction is followed through onto any new title.
