Where a certificate of title is to be given in the form prepared by the City of London Law Society, it is convenient to make use of the supporting Certificate of Title documents designed to assist in the information gathering exercise. These were updated last week, and include a draft letter from the certifying solicitors seeking various confirmations of information from “the Company” (i.e. the client) so that the acting solicitors are able to produce the Certificate; a form of questionnaire – designed as an alternative method of extracting relevant information from the company; and a draft letter to the Company enclosing a final draft of the certificate. This letter asks for confirmation (as is required to be certified by the solicitor) that to the best of the Company’s knowledge, information and belief the information contained in the Certificate is complete and accurate in all respects, and that the Company inspected the relevant property within 20 working days before the date of the certificate.
