Drafting for CRC?

Are you thinking about putting some clauses into leases to deal with the Carbon Reduction Commitment? Well, today, the Committee on Climate Change (“Independent advisors to the UK Government on tackling and preparing for climate change”) has recommended that the Government re-designs the Carbon Reduction Commitment (CRC) energy efficiency scheme prior to the start of the second phase (2013-2017), in order to reduce its complexity. The Minister for Energy and Climate Change is quoted as saying: “My Department asked the Committee on Climate Change to provide advice on the CRC Scheme and today I welcome their response. I have made it clear before now that I want to simplify the bureaucracy of the CRC scheme that the Coalition Government inherited. Today’s report will help inform our thinking on setting the cap for CRC and will feed into our work on simplification of the scheme. In the meantime, I continue to urge businesses to register by the 30th September deadline.” All options for simplification appear to be on the advisory table: “One option would be to drop revenue recycling.” Perhaps the “do nothing” approach to CRC drafting will therefore prove to be the right approach in the end?
